The Function and Classification of Phraseological Units in English Legal Discourse

Abstract

The specialized language of the law is characterized by a high density of expressions essential for its precision and authority. This article investigates the function and classification of phraseological units within English legal discourse. It argues that a systematic, function-based classification of these units is fundamental to ensuring the precision, unambiguity, and authority of legal texts, and that this understanding is becoming increasingly essential as legal communication evolves in a globalized, digitized environment. In a professional landscape characterized by transnational interaction and dynamic legal reforms, translators, drafters, and legal linguists must possess the analytical tools to deconstruct, interpret, and accurately reproduce these specialized building blocks across languages and legal systems.

Grounded in an interdisciplinary framework integrating phraseology, legal linguistics, and discourse analysis, the study employs a qualitative, corpus-based methodology. The analysis draws on a curated selection of contemporary legal texts from two primary genres: commercial contracts and common-law court decisions. This dual-genre approach allows for the identification of both shared and genre-specific phraseological patterns.

By synthesizing insights from phraseology, legal linguistics, and discourse analysis, the study concludes that a mastery of the function and classification of phraseological units is not merely an academic exercise but a core professional competency. It is indispensable for achieving legal equivalence in translation, enhancing the clarity of legal drafting, and preparing future professionals to adapt their expertise to the changing demands of legal-linguistic practice.
