3. The abstract

Introduction.

An administrative offense in the field of customs (violation of customs rules) is an unlawful guilty act (inaction) of an individual or legal entity that infringes on the customs regulation rules established by the customs legislation of the Eurasian Economic Union (EAEU) and the Russian Federation, for which the Administrative Code of the Russian Federation established administrative responsibility [1

Materials and methods. The methodological basis of the study is statistic analyses of cases on administrative offenses. Comparative  legal method and formal-legal method have also been used in the article

Results. Based on the results of the consideration of cases on administrative offenses, 113,200 decisions on the appointment of administrative punishments in cases of administrative offenses entered into force (in 2019 - in 153,959 cases), of which officials of the customs authorities imposed punishments in 92,929 cases (in 2019 - in 123,488 cases), by the court or an authorized body - in 20,271 cases (in 2019 - in 30,471 cases). In 2020, the customs authorities, based on the results of the revision of decisions in cases of administrative offenses, issued 1732 decisions on complaints from persons and protests of prosecutors (in 2019 - 2025 decisions), of which 1289 decisions were made on complaints (in 2019 - 1626 decisions) , on the protests of prosecutors - 443 decisions (in 2019 - 399 decisions). At the same time, 90% of the decisions of the customs authorities, when they were appealed in court, were recognized by the courts as lawful and justified. The practice of considering complaints and protests against decisions in cases of administrative offenses shows that no more than 8% of decisions on sentencing are challenged by higher customs authorities and courts annually
